TERMS AND CONDITIONS OF USE FOR THE FAZEI APPLICATION

1. Definitions and Acceptance

1.1 These Terms and Conditions (“Agreement”) constitute a legally binding agreement between Fazei (the owner of the “Fazei” brand) and the users of the application (both customers and service providers).
1.2 The term “Fazei” or “the Application” refers to the electronic platform that connects road assistance service providers with customers.
1.3 By using or registering on the Application, you expressly agree to abide by all provisions stated herein. If you do not agree with any provision, you must refrain from using the Application.

2. Scope of Service

2.1 Fazei provides a digital platform enabling road assistance providers to connect with customers who need services such as tire repairs, battery jump-starts, fuel delivery, or vehicle towing.
2.2 Fazei’s responsibility is limited to providing this electronic platform and does not extend to the execution or quality of the service itself. The service provider is solely and directly responsible for any issues or shortcomings in service delivery.

3. Eligibility and Right to Access Services

3.1 Your account must not have been previously disabled or banned from using Fazei.
3.2 You must not be a competitor to Fazei, nor offer any services that conflict with the services provided by the Application.
3.3 You represent that you possess the legal capacity to enter into this Agreement, and by doing so, you are not violating any law or contract.
3.4 Fazei may impose restrictions on certain types of services or specific age groups, as deemed necessary and in accordance with the applicable regulations.

4. User Representations and Warranties

By using the Application (whether you are a customer or a service provider), you undertake to:

4.1 Comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.
4.2 Provide accurate and truthful information, and update it on a regular basis.
4.3 Follow any notices or instructions you receive from Fazei through the Application or by any other means of communication.
4.4 Refrain from reproducing, reselling, or distributing any services or content provided by Fazei without express written permission.
4.5 Use the Application solely for personal purposes and not for commercial exploitation, harming others, or harassment.
4.6 Not use the service or the Application to transport illegal items, commit fraud, or deliver prohibited content.
4.7 Avoid any act that disrupts the Application’s performance or damages its reputation, or any attempt to access its source code or confidential data.
4.8 Keep your password confidential and not share it with anyone.
4.9 Comply with any verification procedures requested by Fazei to confirm your identity.
4.10 Refrain from canceling orders after a direct connection has been established between the customer and the service provider, except for a valid reason and after notifying the support center by phone at the announced number.

5. Prohibited Materials

5.1 It is strictly forbidden to transport, exchange, send, or receive the following items via service providers operating under Fazei:

• Any item in violation of regulations (narcotics, weapons, hazardous materials).
• Counterfeit products, items violating intellectual property rights, or pornographic materials.
• Alcoholic beverages or any items requiring a special legal permit.
• Any items prohibited by law or regulatory authorities in the Kingdom of Saudi Arabia.
  5.2 The service provider or Fazei reserves the right to inspect any shipment to ensure its safety and compliance with these terms.
  5.3 Fazei reserves the right to suspend or terminate an account and deny its services to users (whether customers or service providers) who violate these clauses, with the violator bearing any resulting legal liabilities.

6. Pricing and Payment

6.1 Prices are determined by the type of service, the region, and the availability of service providers. They may change at any time without prior notice.
6.2 For general roadside assistance (battery jump-start, fuel, tires), the Application may display fixed prices, whereas towing (flatbed/truck services) may be calculated based on distance, duration, and vehicle type.
6.3 The customer bears full responsibility for settling the service fee immediately upon completion (cash or through the payment methods approved by the Application).
6.4 In the event the “Fazei Meter” (which calculates distance and fees) malfunctions, the fixed fee shown in the Application will apply.
6.5 Any attempt to manipulate or tamper with the meter or the prices may subject the user to financial and administrative penalties, as determined by Fazei in accordance with its regulations.

7. Order Cancellation

7.1 Customers may cancel an order before the service provider makes contact, without incurring a fee.
7.2 Once contact is established between the two parties, cancellation is only permitted for a valid reason, and after notifying the support center by phone.
7.3 Fazei reserves the right to refuse service or cancel an order without explanation if it deems there are violations or repeated misuse.

8. Intellectual Property Rights

8.1 All intellectual property rights—including trademarks, logos, and designs—for Fazei and its Application are solely owned by Fazei.
8.2 It is prohibited to reproduce, modify, publish, or use any materials protected by these rights without prior written consent from Fazei.

9. Legal Liability and Disclaimer

9.1 Service providers performing the requested roadside assistance bear full responsibility for the quality of services and the safety of procedures; Fazei does not intervene in the actual execution of the service.
9.2 The Application and its services are provided “as is,” and Fazei does not guarantee error-free or uninterrupted operation or immediate availability at all times.
9.3 Fazei assumes no liability for damages, losses, or injuries resulting from misuse of the Application or its services, or from violations of these Terms.
9.4 Full responsibility lies with the service provider or the customer in the event of any breach of these Terms or applicable laws.

10. Limitation of Liability

10.1 Fazei, its employees, agents, or licensors will not be liable for any indirect or consequential damages arising from your use of—or reliance on—the Application or the information therein.
10.2 Users are solely responsible for any potential damage resulting from technical failures or data loss. They have no right to seek compensation from Fazei unless they prove willful gross negligence on the part of Fazei.

11. Indemnification

11.1 You agree to indemnify, defend, and hold harmless Fazei, its affiliates, and its employees from and against any claims, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of:

• Your breach of any provision in these Terms.
• Your violation of any third-party rights or any applicable law or regulation.
• Your use or misuse of the Application in a manner deemed unlawful or contrary to these Terms.

12. Modifications and Right to Terminate

12.1 Fazei reserves the right to modify these Terms at any time without prior notice. Changes take effect immediately upon being posted on the website or within the Application.
12.2 Your continued use of the Application after the changes are posted constitutes your implied acceptance of such modifications.
12.3 Fazei may terminate or suspend your access to the Application immediately if you violate any provision of these Terms, without bearing any liability to you.
12.4 You have the right to terminate this Agreement at any time by deleting the Application from your device and ceasing any further use.

13. Governing Law and Dispute Resolution

13.1 These Terms and Conditions are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia.
13.2 Any dispute arising from or related to the interpretation or implementation of these Terms shall be settled according to the judicial procedures of the competent courts in Saudi Arabia.

14. Data Privacy

14.1 The collection and processing of personal data is handled in accordance with the Privacy Policy published by Fazei.
14.2 You are advised to review the Privacy Policy to understand how your data is collected, used, and shared.

15.1 For any inquiries or complaints regarding your use of the Application or the services provided, you may contact the support team via the designated phone number or any other channels made available in the Application.
15.2 Fazei is committed to providing quality customer service and will strive to respond to and address inquiries and complaints as quickly as possible.
